These Terms are a binding agreement between you and Matteo Farinacci, the developer of MotorDex. By using MotorDex you agree to these Terms. You must be at least 13 to use MotorDex. If you are between 13 and 18 (or the age of majority where you live), you may use MotorDex only with the involvement and agreement of a parent or legal guardian, who agrees to these Terms and our Privacy Policy on your behalf and is responsible for your use. As described in our Privacy Policy, precise-location capture is off for users under 16. Before posting any content you accept these Terms; if you do not agree, do not post content or use the social features.
MotorDex lets you photograph cars, identify them with AI, and collect them as cards. AI identification is best-effort and sometimes wrong — that's part of the game, and catches can be re-tried or removed. Names, specs, and trivia are for entertainment and may contain inaccuracies.
READ THIS. MotorDex requires you to move through the REAL WORLD to photograph vehicles, and that carries real risk. YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY, YOUR SURROUNDINGS, AND YOUR CONDUCT AT ALL TIMES. • NEVER use MotorDex — including scanning, aiming the camera, or looking at the screen — while driving, riding, cycling, or operating any vehicle, machinery, or equipment, or at any time your attention is needed for safety. DO NOT SCAN AND DRIVE. • Always obey all laws, including traffic, pedestrian, trespass, privacy, and photography laws. Stay on safe, legal, public ground. Watch for traffic, moving and reversing vehicles, and other hazards. Respect private property, restricted and no-photography areas, and other people's privacy and wishes. Never enter a roadway, highway, railway, parking structure, construction site, or private property unsafely or without permission, and never put yourself or anyone else in danger to get a photo. No car is worth an injury. • Be a responsible adult about your surroundings — do not trespass, do not confront vehicle owners or others, and walk away from any situation that feels unsafe. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU EXPRESSLY ASSUME ALL RISK arising from your use of MotorDex in the physical world, and you release, waive, and agree not to hold us, our developer, or our service providers liable for any personal injury, illness, death, property damage, vehicle collision, trespass, ticket, fine, citation, arrest, detention, confrontation, altercation, or any other loss or harm — to you OR to any other person — arising out of or in any way relating to your movements, your location, your driving or operation of any vehicle, your distraction or inattention, or your interactions with people, vehicles, property, animals, or authorities while using MotorDex or while doing anything motivated by MotorDex. THIS ASSUMPTION OF RISK AND RELEASE IS A MATERIAL PART OF THIS AGREEMENT AND APPLIES EVEN IF WE ARE ALLEGED TO HAVE BEEN NEGLIGENT. It does not apply only to liability that cannot be waived under applicable law.
MotorDex shows content created by OTHER users — catch photos, profile photos, handles, and reactions — that we do not create and cannot fully control. We screen images automatically before they can appear and we remove reported violations, but AUTOMATED SCREENING AND HUMAN REVIEW ARE SAFEGUARDS, NOT GUARANTEES: you may still be exposed to content that is inaccurate, offensive, harmful, unlawful, or otherwise objectionable. YOU ACKNOWLEDGE AND ASSUME THIS RISK. To the maximum extent permitted by law, we are not responsible or liable for any user content, for any exposure to it, or for any reliance on or consequence of it. If you see something, USE THE IN-APP TOOLS: Report flags content for review (typically within 24 hours) and Block immediately hides that user's profile and content from you and bars them from contacting you. We may, but are not obligated to, monitor, screen, or remove content, and we may remove any content and suspend or terminate any account at our sole discretion, with or without notice. If you believe you have encountered content that sexually exploits a minor, do not just report it in-app — report it to the National Center for Missing & Exploited Children (report.cybertip.org) and law enforcement; we cooperate with authorities and remove such content and accounts immediately.
We grant you a personal, limited, non-transferable, revocable licence to use MotorDex on Apple devices you own or control, consistent with the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or abuse the service.
We have ZERO TOLERANCE for objectionable content and abusive users. Content that is illegal, hateful, harassing, sexual, violent, or otherwise objectionable, and users who post it or abuse others, are not permitted. You can report objectionable content or block any user from inside the app. We review every report and will remove violating content and suspend or permanently remove offending users — promptly, and typically within 24 hours of a report. By using MotorDex you agree there is no tolerance for this content or behavior. • You keep ownership of your photos. By scanning or uploading a photo you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, reformat, crop, transmit, and display that photo and its derivatives (including a cropped image and a stored original) to operate MotorDex — including sending it to our identification provider (Google Gemini) to identify the car, and showing it on your Catch Cards and map and to friends you add. Each photo is reachable through an unlisted, unguessable link, so anyone you share a card or link with can view it. You represent that you own or have the rights to the content you upload and that it does not break any law or any person's rights (including privacy, publicity, and intellectual-property rights). This licence ends when you delete the content or your account, except for copies already shared and reasonable backups. • Only photograph cars. No identifiable people, private property interiors, or anything illegal, hateful, sexual, harassing, or infringing. • Don't harass others, impersonate anyone, cheat, or disrupt the service. • Rule-breaking content can be removed and accounts suspended or deleted. Use the in-app Report and Block tools — reports are reviewed within 24 hours. • Automated screening: images (scans and profile photos) are checked automatically before they can appear, and objectionable images are refused. Automated screening is a safeguard, not a guarantee — the Report and Block tools remain the primary way to flag anything that slips through, and blocking a user immediately hides their profile and content from you. You also may not scrape or data-mine the app or its catalog, access another user's account, probe or circumvent security, upload malware, or use the app for any unlawful purpose. We may remove content and suspend or terminate accounts at our discretion, including for any violation of these rules.
Pro is optional, offered as a monthly auto-renewing subscription or a one-time lifetime purchase, billed through your Apple account. A monthly subscription renews automatically unless cancelled at least 24 hours before the period ends; manage or cancel anytime in your Apple subscription settings. Purchases are also subject to Apple's Standard EULA (apple.com/legal/internet-services/itunes/dev/stdeula). Free-tier limits are described in the app.
MotorDex shows performance figures, original prices, current market-value ranges, production counts and rarity grades on Catch Cards. THESE ARE AI-GENERATED ESTIMATES MADE FROM A PHOTOGRAPH, FOR ENTERTAINMENT, AND THEY ARE OFTEN WRONG. They are not appraisals, valuations, inspections, provenance records, or authentication of any kind, and they are not investment, financial, insurance, tax, or purchasing advice. A card that calls a car rare, limited-production, "1 of N", or worth a particular amount is a guess: we have not inspected any vehicle and have not verified any VIN, chassis number, build sheet, or document. DO NOT RELY ON MOTORDEX WHEN BUYING, SELLING, INSURING, VALUING, IMPORTING, OR MAKING ANY OTHER DECISION ABOUT A REAL VEHICLE — get an independent professional inspection and appraisal. TO THE MAXIMUM EXTENT PERMITTED BY LAW WE ARE NOT LIABLE FOR ANY LOSS ARISING FROM RELIANCE ON ANY IDENTIFICATION, SPECIFICATION, PRICE, VALUE, PRODUCTION COUNT, RARITY GRADE, OR OTHER INFORMATION IN THE APP.
MotorDex lets you import photos from your camera roll — one at a time, in burst sequences, or in bulk. Importing many at once does not reduce your responsibility for any single one of them. YOU REPRESENT AND WARRANT THAT, FOR EVERY IMAGE YOU UPLOAD: you took it yourself or hold all rights needed to upload it; it is not someone else's photograph, screenshot, press shot, stock image, or other copyrighted work; you have the consent of any identifiable person in it; and it infringes no law and no third party's privacy, publicity, or intellectual-property rights. Photograph cars, not people. Do not upload images you found online. We remove infringing material, we TERMINATE REPEAT INFRINGERS, and you indemnify us for claims arising from what you upload.
Scanning is rate-limited to keep the service affordable. Automated, scripted, or bulk-abuse use is not permitted and may be blocked.
MotorDex — its design, pixel art, name, and software — is owned by us and protected by law. These Terms grant you no rights in it beyond using the app. All vehicle manufacturer and model names, marks, and logos are the property of their respective owners; MotorDex is independent and is not affiliated with, sponsored by, or endorsed by any manufacturer, and uses their names only to identify the real cars you catch.
MOTORDEX IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MOTORDEX WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY AI-GENERATED CAR IDENTIFICATION, NAME, SPEC, VALUE, OR FACT IS ACCURATE, COMPLETE, OR RELIABLE. YOU USE MOTORDEX AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR CONDUCT AND SURROUNDINGS WHILE USING MOTORDEX. The app requires you to move through the physical world to photograph vehicles. Always obey all laws, respect private property and others' privacy, stay aware of traffic and hazards, and never trespass, enter roadways unsafely, or use the app while driving or operating a vehicle. YOU ASSUME ALL RISK arising from your use of MotorDex in the physical world, and TO THE MAXIMUM EXTENT PERMITTED BY LAW WE ARE NOT LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, TRESPASS, CITATION, ARREST, ALTERCATION, OR OTHER LOSS arising from your conduct, your location, or your interactions with people, vehicles, or property while using the app. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR DEVICE OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO MOTORDEX OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO MOTORDEX WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR MOTORDEX IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE EXCLUSIONS OR LIMITATIONS, SO SOME MAY NOT APPLY TO YOU; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, you release and forever discharge us, our developer, and our service providers from any and all claims, demands, causes of action, damages, liabilities, losses, and expenses of every kind and nature, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with: your use of MotorDex; your content; your conduct, movements, driving, or location in the physical world; and any other user's content or conduct. IF YOU ARE A CALIFORNIA RESIDENT, YOU EXPRESSLY WAIVE CALIFORNIA CIVIL CODE SECTION 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any comparable statute or rule of any other jurisdiction. You understand and agree that you are releasing claims you may not currently know or suspect exist, and that this is a bargained-for part of these Terms.
To the maximum extent permitted by law, you will indemnify, defend, and hold harmless MotorDex, its developer, and its service providers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your photos or other content; (b) your use or misuse of MotorDex; (c) your violation of these Terms or of any law or third-party right, including privacy, publicity, and intellectual-property rights; (d) your conduct, driving, or location in the physical world while using or motivated by the app; and (e) any injury, death, damage, or loss you cause to any person or property while using or motivated by the app. We may assume the exclusive defense and control of any matter subject to your indemnity, and you will cooperate with our defense.
We respect intellectual-property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act. If you believe content in MotorDex infringes your copyright, send our designated agent a notice that includes: your contact details; identification of the work; identification and location of the allegedly infringing material; a statement of your good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act; and your physical or electronic signature. Send copyright-infringement notices to our copyright contact at support@motordexgame.com. (We may register a designated agent with the U.S. Copyright Office; until then, use this email.) We will remove or disable access to material as required, may forward your notice to the user, and accept counter-notices. WE TERMINATE THE ACCOUNTS OF REPEAT INFRINGERS in appropriate circumstances.
PLEASE READ — THIS AFFECTS YOUR LEGAL RIGHTS. Except for (i) claims you may bring in small-claims court and (ii) either party's request for injunctive relief to protect intellectual property, YOU AND WE AGREE TO RESOLVE ALL DISPUTES BY BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules, governed by the Federal Arbitration Act, seated in California or, at your election, your home county. YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION; disputes will be arbitrated only on an individual basis. If the class-action waiver is held unenforceable as to any claim, that claim, and only that claim, will proceed in court. YOU MAY OPT OUT of this arbitration agreement by emailing support@motordexgame.com within 30 days of first accepting these Terms, stating your handle and that you opt out; opting out does not affect the rest of these Terms. This section does not apply to Apple, which is not a party to it.
This agreement is between you and us, not Apple, and Apple is not responsible for MotorDex or its content. Apple has no obligation to provide maintenance or support for MotorDex. If MotorDex fails to conform to any applicable warranty, you may notify Apple and Apple will refund any unused purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. WE, NOT APPLE, ARE RESPONSIBLE for addressing any claims relating to MotorDex, including (a) product-liability, legal, or regulatory non-conformance claims, and (b) any third-party claim that MotorDex or your use of it infringes that party's intellectual-property rights — we are solely responsible for the investigation, defense, settlement, and discharge of any such claim. You must comply with any applicable third-party terms (for example your wireless carrier's) when using MotorDex. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a U.S.-embargoed country or on a U.S. government prohibited-parties list. Your licence to use MotorDex is also subject to Apple's Standard End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula).
You may stop using MotorDex anytime and delete your account in Settings. We may suspend or terminate accounts that violate these Terms. On termination your licence ends and you must stop using MotorDex; we may delete your account and data. The following survive termination: your content licence (as to copies already shared), Our intellectual property, Disclaimers & liability, Your indemnity, Dispute resolution, and the General provisions.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, you and we agree it will be brought exclusively in the state and federal courts located in California, and you and we consent to personal jurisdiction and venue there and WAIVE ANY RIGHT TO A JURY TRIAL to the extent permitted by law. If you are a consumer resident in the EEA or UK, nothing in these Terms removes the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in your local courts. We may update these Terms from time to time. We will post the updated Terms with a new "Updated" date and, for material changes, provide notice in the app. Changes take effect when posted (or on a later stated date). Your continued use of MotorDex after changes take effect means you accept the updated Terms; if you do not agree, stop using the app and delete your account. Contact: support@motordexgame.com.
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force and effect. These Terms and the Privacy Policy are the entire agreement between you and us about MotorDex and supersede any prior understandings. Our failure to enforce any provision is not a waiver of it, and no waiver is effective unless in writing. You may not assign or transfer these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including network or hosting outages, failures of third-party providers (such as our backend, AI identification, payment, or app-store providers), government action, or acts of God.
